He was discharged with a note that his condition was “good,” though his pain remained severe.

The family has filed a state-court medical malpractice lawsuit scheduled for trial in January 2026. In addition, a federal lawsuit claims the hospital violated the Emergency Medical Treatment and Labor Act (EMTALA), which requires hospitals to stabilize patients before discharge. The hospital has denied wrongdoing and has yet to respond formally to the federal claim.
